That the brand fee as provided in this Act shall not apply to anv fertilizer mixed according to a formula furnished by a consumer; provided, in lieu of the registration, all packages of fertilizersshall be plainIv marked, or tagged, on the outside of the Dackage with the words "Mixed to Order," together with a statement thereon of the guaranteed Analysis, and in all the other particulars said mixed fertilizer shall conform to the provisions of this Act. Sec. 15. That every person, firm, corporation, or association, guilty of a violation of any of the provisions contained in Sections No. 2, 4, 5, 6, 7 and 9 of this Act. and every officer, manager, director or managing: agent of any such nerson, firm, corporation, or association, directly participating in such violation, or consenting thereto, shall be punishable by a fine of $100.00 for the first offense, and, upon a second conviction, shall be punished by a fine of $500.00 or imprisonment for not more than three months, or both, at the discretion of the Court. And it shall be the duty of the State's Attorneys of the several counties of this State to prosecute all violations of any of the provisions contained in said Sections Nos. 2, 4, 5, 6, 7 and 9 brought to their attention, said prosecutions to be in the name of the State of Maryland, and the penalty recovered, when paid, to be turned into the fertilizer fund of the Maryland State College of Agriculture. Sec. 16. That if anv person, firm, or corporation, subject to the provisions of this Act shall fail to file the statement required in Section No. 3 herein reearding the tons of fertilizer sold, and to pay the inspection fee, provided therefor in this Act. within sixty (60) days after the close of the calendar year, the same shall subject sa...
